Workshop on Article 36 of Interreg Regulation

Procedures Irregularities

Article 36 of the Interreg Regulation outlines the responsibilities of managing authorities and project partners regarding transparency and communication and the consequences of not fulfilling the requirements. Applying the 2% cut is the last resort for the managing authority if the beneficiaries and/or final recipients do not comply with the rules on transparency and communication.

Interact, in collaboration with DG Regio, organises this workshop as a follow-up to the meeting held in 2023. After this workshop, experts from Interreg programmes and the specific department in DG REGIO initiated the procedure for a questions and answers document. Please note that the questions and answers document concerning the "up to 2% cut" has been published and is now available on the Interact communities. 

However, specific points require further clarification. We also want to explore if there are ways to harmonise the procedures among programmes. The main objective of this workshop is to provide a platform for participants to discuss and share their views on how managing authorities can consider the potential cases and decide on proportionality when cancelling up to 2% of the funding. We welcome the programmes to share any practical experiences they might have already. Additionally, there are questions to discuss together, such as: how are you (planning to) verifying the evidence of a clear breach of the regulation and allow the beneficiary to implement remedial actions? How does the use of simplified cost options affect the procedure? 

This workshop is open to all programme staff from the managing authorities, joint secretariats and different relevant programme bodies involved in the topic.
